| Medical Negligence / Malpractice Medical negligence or malpractice involves care delivered by a health care provider such as a physician or health care institution, that falls below an accepted or reasonable standard. A loss or injury must result that is related to the failure to meet the standard and not something else. Medical negligence cases also involve the failure of care providers to fully explain the side effects or risks of any sort of treatment to the extent that the patient can make an informed choice. Failure to fully explain or warn of any potential side effects can give rise to a claim if injury results from this treatment. Remainder of this section is under construction.
